Trade Marks, are often valuable commercial assets of a company and sometimes may not have been registered. Since UK law now gives priority to the first to register a mark, unless a significant reputation can be shown to exist based upon earlier use, it is important that trade marks are registered as soon as possible.
Registration gives an immediate right to stop someone with the same or similar mark on the same or similar goods and services without the need to prove reputation or demonstrate confusion, as would be necessary under 'common law' in respect of unregistered marks.
